VILLAGE OF TWIN LAKES RESOLUTION 2024-5-4

RESOLUTION OF VILLAGE BOARD EXERCISING REFERENDUM OPTION

Village of Twin Lakes, Kenosha County

Whereas, the State of Wisconsin has imposed limits on town, village, city and county property tax levies under Wis. Stat. sec. 66.0602; and

Whereas, Wis. Stat. sec. 66.0602 limits the increase in 2024 (to be collected in 2025) to the local property tax levy to no more than the greater of (a) 0% of last year’s actual levy or (b) a percentage equal to the percentage change in equalized value due to new construction less improvements removed; which for the Village of Twin Lakes is estimated to be 1.577%; and

Whereas, the Board of Trustees of the Village of Twin Lakes, Kenosha County believes it is in the Village’s best interest to exceed the state levy limit as described above by a greater percentage than 1.577%for the purpose of providing funding for four (4) emergency medical service positions; and

Whereas, the Village of Twin Lakes actual levy in 2023 (collected in 2024) was $4,427,532; and state law would limit the increase to $78,810 ($59,819 adjustment from net new construction plus an $18,991 increase in the debt service adjustment from the prior year) for a total allowable 2024 (collected in 2025) village tax levy of $4,506,342.

Now, Therefore the Board of Trustees of the Village of Twin Lakes, Kenosha County does hereby resolve and order as follows:

  1. The Village Board supports an increase in the Village tax levy for 2024 (to be collected in 2025) that will exceed the amount allowed by the state levy limit by 11.682 percent($526,436 ÷ $4,506,342), which would increase the Village levy by $526,436 for a total Village tax levy (after adjustments) of $5,032,778. The requested increase would apply on an ongoing basis.
  2. The Village Board directs that the question of increasing the allowable Village tax levy for 2024 (to be collected in 2025) by 11.682 percent over the 2024 allowable levy be put to referendum at an election on August 13, 2024.
  3. The question shall be submitted to the electors as follows: “Under state law, the increase in the levy of the Village of Twin Lakes for the tax to be imposed for the next fiscal year, 2025, is limited to 1.577%, which results in a levy of $4,506,342. Shall the Village of Twin Lakes be allowed to exceed this limit and increase the levy for the next fiscal year, 2025, for the purpose of providing funding for four (4) emergency medical service positions, by a total of 11.682%, which results in a levy of $5,032,778, and on an ongoing basis, include the increase of $526,436 for each fiscal year going forward?”
